Professional negligence
Professional negligence is when a service provided by a company is not provided in appropriate fashion. For example, a obvious example would be a lawyer who loses your injury claim documents and this puts your opportunity to gain your rightful compensation at risk. In such a situation, it is clear that the stressful consequences of the lawyer's behaviour would cause both psychological and perhaps, if originally dealing with an injury claim, physical damage to the claimer. As such, in any such situation, the claimer would be entitled to compensaton for professional negligence.
To prove professional negligence, you have to show that lawyers have not provided you with the care you deserve through showing how their level of performance was not as high as it should be. For example, this could include, but is not limited to, your lawyer giving you innacurate advice, not acting within pre-defined time-limits or your lawyer losing or misplacing your personal information.
It is important to note that any case for proffessional neglicence depends on the fact that you would have been better off had he have not acted negligently. For example, if you have lost a case, but your lawyer did not behave negligently, then you would not be entitled to compensation as your outcome would have been the same with the lawyer or without.
